REQUIRING LANDLORD’S TIMELY REPORTING OF
TENANTS IN
THE VILLAGE OF McCULLOM LAKE
WHEREAS, the Village of McCullom Lake is serviced by municipal sanitary sewer service through an intergovernmental agreement with the City of McHenry; and
WHEREAS, the Village is charged by the City of McHenry based upon the usage of the sanitary sewer system by the residents of the Village; and
WHEREAS, the Village recognizes that there is a large percentage of non-owner tenants residing in the Village; and
WHEREAS, the Village has determined that there is a need to accurately assess the population present within the Village to prevent over-charges from the City of McHenry for increased sanitary sewer demands.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of McCullom Lake, McHenry County, Illinois, as follows:
SECTION
1: The above recitals are incorporated herein.
SECTION
2: The following shall be added to
the Codes of McCullom Lake as and for the additional landlord
requirements within the Village:
LANDLORD
REPORTING OF TENANTS
I. Definitions
(for the purposes of this act):
i. Landlord: Any person, persons or entity that owns any single
family or
multifamily residential unit or units within the municipal boundaries
of the Village and collects money or payment from third persons or
parties for the rental or leasing of same.
ii. Property: All lands, buildings, dwellings, or structures
physically present at
the common address which are owned or controlled by landlord.
iii. Dwelling: The actual house, apartment, condo and/or living
space present on
the property and owned or controlled by Landlord.
iv. Tenant: Person or persons residing on the Property of a
Landlord for periods
of longer than seven (7) days whether party to a lease or not and
whether or not that individual pays a fee of any kind. Includes any
and all children, relatives, friends, etc. A person is a tenant for
the purposes of this act if they are present on the premises or
property of a landlord with the intent of inhabiting the landlord’s
property for longer than seven (7) days.
v. Report. Document prepared by a landlord to be filed with the Village which sets forth the common property address, the number of tenants which currently reside at the residence and the anticipated date that the tenancy will end, if known.
II. Landlord’s
duties
(a)
Any landlord within the Village shall be obligated to report the
number of tenants present on any and all properties located within
the Village. Said report shall be made in writing and mailed or
delivered to and filed by the Village Clerk. Said report shall be
used by the Village for the purposes of determining the correct
amount of charges to be levied against the property as and for
monthly sewage treatment rates. The report shall be verified and
signed by the landlord.
(b)
All landlords shall be required to report changes in the number of
occupants in any of their properties within the Village within
fourteen (14) days of there being a change in that number.
(c) All landlords shall file their initial reports with the Village within thirty (30) days of the effective date of this Ordinance.
III. Penalties
(a)
Failure of any landlord to report the number of tenants inhabiting
any of the landlord’s property within the Village in a timely
manner shall result in the Village levying the maximum charges
allowed by ordinance and by law.
(b)
If, upon due inspection, the Village determines that there is in
inaccuracy in the report submitted by landlord, the Village shall
notify the landlord in writing and allow the landlord the opportunity
to resubmit a report.
(c)
If, upon due inspection, the Village determines that a landlord has
knowingly submitted a false report, the Village shall issue a
Violation to the landlord. If found guilty, the landlord shall be
fined not less than $50.00 or more than $500.00 for each occurrence.
SECTION 3: This Ordinance shall be in full force and effect thirty (30) days after its passage and publication as required by law.
SECTION
4: All Ordinances or parts of Ordinances in conflict with this
Ordinance are hereby repealed to the extent of such conflict.
SECTION 5: If any provision, clause, sentence, paragraph, section, or part of this Ordinance or application thereof to any person, firm corporation, public agency or circumstance, shall, for any reason, be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of this ordinance and the application of such provision to other persons, firms, corporation, or circumstances, but shall be confined in its operation to the provision, clause, sentence, paragraph, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered and to the person, firm, corporation ,or circumstances involved. It is hereby declared to be the legislative intent of the Village of McCullom Lake that this Ordinance would have been adopted had such unconstitutional or invalid provision, clause, sentence, paragraph, section, or part thereof not have been included.
